Minutes:
The Board of Adjustment of the City of Lake Dallas met in a regular meeting on September 18, 2006 at 7:00 p.m. in the Lake Dallas City Hall, 212 Main Street, Lake Dallas, Texas with notice of the meeting posted as required by Title 5, Chapter 551.041 of the Texas Government Code.


1. Roll Call:
Members Present: Bruce Martin, Steven Bertrand, Sandy Payne, Dylan Smith and James Harper.
Also present: City Manager Earl Berner and Planning and Zoning Secretary Char
DuPree.


2. Consideration and Action on approval of Minutes for the June 19, 2006 meeting.
Motion to approve Minutes for the June 19, 2006 meeting was made by Steven Bertrand. Second by Sandy Payne.
Ayes: Steven Bertrand, Sandy Payne, Dylan Smith and James Harper.
Noes: None
Motion Passed


3. Public Hearing on request for a proposed special exception regarding the replat of the north half of Lot 25, Block H, of Garza Beach Estates, Lake Dallas, Denton County, Texas. The replat will allow for four (4) lots of 50’ x 100’ each, or 5000 sf each in an R- 1-6000, Single Family Dwelling district (6000 sf lots).
John Donahue from Kilkenny Building Company represented Robert Meadows, who owns 306 Boliver and 403 Stockard. Mr. Donahue explained these properties were platted in 1926 for a community center. Mr. Meadows is willing to sell these properties to Mr. Donahue at a price he can afford so he can build 8 new brick homes that will be approximately 1300 sq. ft. They will be 3 bedrooms and have 2 baths, meeting all building requirements for R1-6000 zoning. The lots will be 50 ft. x 100 ft. The tax base for these homes will be approximately $425,000.00. Mr. Donahue previously built 42 similar homes on Texas Street and Boliver.
Steven Bertrand closed the public hearing.


4. Consideration and Action on approval of a proposed special exception regarding the replat of the north half of Lot 25, Block H, of Garza Beach Estates, Lake Dallas, Denton County, Texas. The replat will allow for four (4) lots of 50’ x 100’ each, or 5000 sf each in an R-1-6000, Single Family Dwelling district (6000 sf lots).

The Board felt this is not an uncommon request given the other homes in this area. The Members felt comfortable these homes would improve the area and the City tax base.
Motion to approve the proposed special exception regarding the replat of the north half of Lot 25, Block H of Garza Beach Estates was made by Bruce Martin. Second was made by Dylan Smith.
Ayes: Bruce Martin, Steven Bertrand, Sandy Payne, Dylan Smith and James Harper.
Noes: None
Motion Passed


5. Adjournment
Steven Bertrand adjourned the meeting at 7:17 p.m.
